These terms apply to web design and development work supplied by Sitebirch, a UK-based one-person service. Your accepted quote and written scope form part of the agreement. If the quote says something different for your project, the quote takes priority.
1. Quotes and project scope
A quote describes the agreed deliverables, price, estimated timing, revision rounds and known outside costs. A project is booked when you accept the quote in writing and pay any deposit stated in it.
A quote is based on the information available at the time. If the requirements change or important information was missing, Sitebirch will explain the effect on price or timing before carrying out the affected work.
2. Deposits and payment
The quote states whether a deposit is required, its amount, the payment method and when later payments are due. There is no single fixed deposit or payment schedule for every project.
Work begins after any required deposit has cleared and the information needed to start has been supplied. Sitebirch may pause work if an agreed payment is overdue. Final files, account transfer or launch may be held until the agreed balance is paid.
3. What you need to provide
You are responsible for supplying accurate content, instructions, approvals and access in a usable and timely form. You confirm that you have permission to use any text, images, logos, data or other material you provide.
Do not send passwords by ordinary form or email. Where possible, use secure collaborator access for website, domain and service accounts.
4. Revisions
The number of included revision rounds is stated in the package or quote. A revision is a reasonable refinement to work already included in the agreed scope.
Unused revisions have no cash value. Additional rounds, a new direction after approval, or requests outside the agreed scope count as extra work and need a separate approved quote.
5. Timelines
Dates are estimates unless the quote expressly guarantees a deadline. Timing begins after the scope is agreed and Sitebirch has received required content, access, decisions and any deposit.
Delays in feedback, content, access, payment or third-party services may move the delivery date. Sitebirch will communicate any material change as soon as reasonably possible.
6. Extra work
Extra work includes new pages, features or integrations; changed requirements; replacement content; additional revision rounds; urgent delivery; and maintenance or support not included in the quote.
Sitebirch will explain the added scope, fee and likely timing. Extra work starts only after you approve it.
7. Ownership and handover
You keep ownership of content and branding you supplied. Where possible, your domain, hosting and service accounts stay in your name.
After full payment, you own the finished custom website files and original design work created specifically for your project, unless the quote states otherwise. Sitebirch keeps ownership of pre-existing methods, reusable tools and know-how. Open-source software, fonts, themes, plugins, stock media and other third-party materials remain subject to their own licences.
8. Third-party costs and services
Domain registration, hosting, premium themes, plugins, fonts, stock media, business email, APIs, payment-provider fees, messaging charges and other paid tools are separate unless the quote expressly includes them.
Prices, renewals, uptime, account approval and service changes are controlled by the relevant provider. Sitebirch will identify known required costs before purchase, but cannot control a third party’s future price or availability.
9. Cancellation
You may cancel by writing to contact@sitebirch.com. You must pay for work completed up to cancellation and any non-refundable third-party cost already approved and incurred for the project. Sitebirch will return any remaining client-owned materials and explain what can be handed over in its current state.
If Sitebirch has to cancel, you will receive completed work that has been paid for and a refund of any payment covering work not carried out, excluding approved non-refundable third-party costs.
If you are a consumer, these terms do not remove any statutory cancellation or other consumer rights that apply to you. If you ask work to begin during a legal cancellation period, Sitebirch will first explain any effect that request has on payment or cancellation rights.
10. After launch
Any included post-delivery support is stated in the quote. Later changes, maintenance and urgent support are separate unless covered by an agreed monthly maintenance plan.
A website may be affected by browser updates, security changes and third-party services after handover. Ongoing monitoring is not included unless it is expressly agreed.
11. Contact and fair dealing
Both sides agree to communicate honestly and give reasonable notice of problems that could affect the work. Nothing in these terms excludes rights or responsibilities that cannot legally be excluded.
